bre — Terms of Service

1. The agreement

These terms are between you and BRE LLC ("bre", "we", "us"). By downloading or using the bre app you agree to them. If you do not agree, do not use bre.

You must be at least 13 years old to use bre. If you are under the age of majority where you live, you may only use bre with a parent or guardian's permission. Kids mode is different: it is for an adult to run for a child, as described in §2.

2. What bre is — and what it is not

bre turns a topic into a podcast conversation between AI hosts.

The hosts are not real people and nothing they say is checked by a human. Episodes are generated. They can be wrong, out of date, biased, or confidently incorrect about things that sound authoritative. Treat an episode as a starting point, not a source.

Kids mode is run by a parent or guardian. Kids mode is used on a parent or guardian's own account, and they are responsible for choosing it and for what a child listens to. The child only listens. In Kids mode nothing is recorded: there is no microphone, no Talk and no hands-free listening, no questions are collected from the child, and bre keeps no memory of what was played. bre is not in Apple's Kids Category. If you are not an adult, do not sign in to bre to set up Kids mode.

bre is not advice. Nothing in an episode is medical, legal, financial, psychological or safety advice, and no episode is a substitute for a qualified professional. If something in an episode matters to a decision you are making, verify it elsewhere before you act on it.

bre is not a crisis service. If you are in danger or thinking about harming yourself, please contact your local emergency number or a crisis line. In the US and Canada you can call or text 988; in the UK and Ireland, 116 123 (Samaritans). A list for other countries is at https://findahelpline.com.

3. Your account

You need an account to make episodes. You are responsible for keeping access to it secure, and for what happens under it.

You can delete your account at any time from inside the app, under Settings. Deleting it removes your data as described in our Privacy Policy. Deleting your account does not on its own cancel a subscription — subscriptions are billed by Apple or Google and must be cancelled with them, as described in §4.4.

We may suspend or close an account that is being used to break these terms, to abuse the service, or in a way that is unlawful. Where we can, we will tell you why first.

4. Subscriptions, billing and cancellation

bre has no free tier. To make episodes you subscribe to one of two plans.

4.1 The plans

The allowance is weekly on both billing periods: a yearly plan gives the same hours each week as the weekly one, and does not bank them for the year.

On bre Ultra, the deep-research model is a fair-use part of the weekly allowance: it counts the minutes of script it writes, whether or not you go on to listen to them, and once it has written 1.5 hours in a week the rest of that week's allowance is made with the standard models. The app tells you before you use it up.

Free trial on the yearly plans. The yearly plans may be offered with a free trial; the weekly plans are not, and the store decides who is eligible. During the trial you get a trial allowance, not the plan's weekly allowance: up to 30 minutes of generated audio in total, across as many episodes as you like, and 10 minutes of Talk, with the standard models only. It does not reset during the trial. When the trial converts to the paid plan (§4.6), the plan's full weekly allowance begins, counted from that day. If you cancel during the trial, you keep the trial allowance until the trial ends and are not charged.

Prices are shown in your local currency on the purchase screen inside the app, and that screen is authoritative. Prices may differ by country and may include tax depending on where you are.

4.2 Auto-renewal — please read this part

Both plans renew automatically. Unless you cancel, your subscription renews at the end of each period and your payment method is charged again at the then-current price. Renewal happens within 24 hours of the end of the current period.

We will send you a reminder before each renewal charge, and you can turn those reminders off only by cancelling the subscription.

If the price changes, you will be told in advance and asked to agree before the new price is charged. If you do not agree, the subscription will not renew.

4.3 Your allowance

Each plan includes a weekly allowance of generated audio, measured in the length of the audio made, and a weekly allowance of Talk, bre's spoken conversation for planning an episode. The app shows you what you have left at any time.

4.4 Cancelling — which is as easy as subscribing

You can cancel at any time, and cancelling takes the same number of taps as subscribing.

Cancel at least 24 hours before the period ends, or that period's renewal may already have been charged. When you cancel you keep access until the end of the period you have already paid for — we do not cut you off early.

4.5 Refunds

Purchases are processed by Apple or Google, so refunds are handled under their policies, not ours:

4.6 Free trials, if we offer one

If a plan is offered with a free trial, the trial converts into a paid, auto-renewing subscription at the end of the trial period unless you cancel at least 24 hours before it ends. The length of the trial and the price that follows it are shown before you start it.

5. What you may and may not do

Use bre for your own listening, and do not use it to:

6. Content

Your input stays yours. You keep whatever rights you have in the topics and files you give bre.

The episodes bre makes for you are yours to keep and listen to, including offline. You may share them personally. You may not publish or distribute them commercially, or present them as a human-made recording, without our written permission.

You are responsible for what you feed into bre. If you attach a file, you are telling us you have the right to use it that way.

Everything bre says is AI speech, and it is labelled. Every episode bre makes is synthetic speech. The audio files carry a machine-readable "AI-generated by bre" mark in their metadata (WAV INFO and MP3 ID3 tags), and a header saying so when they are downloaded, and Talk opens every session by saying that bre is an AI. You may not remove or alter that label, or use the audio to pass it off as a recording of a real person. bre's hosts are fictional characters and will not imitate a named real person.

bre and its software, brand, name, voices and design are ours and stay ours. Nothing here gives you a licence to them beyond using the app.

If you believe something bre produced infringes your copyright, write to support@askbre.app with enough detail to identify the work and we will act on it.

bre's memory (optional)

bre can remember what you listen to, what you ask and what you tell it to remember, so later episodes build on earlier ones. Memory is off unless you turn it on, and you can see what it holds, delete any of it, or turn it off at any time. What it keeps, why, for how long, who receives it and how to delete it are set out in §2.6 of our Privacy Policy, and they are part of what you agree to when you turn it on.

7. Availability

We try to keep bre running and we do not promise it always will be. We may change, suspend or discontinue features. If we discontinue a paid feature that you are mid-subscription for, we will give you a pro-rata refund for the unused part or an equivalent alternative.

8. Disclaimers

To the fullest extent the law allows, bre is provided "as is", and we disclaim all implied warranties including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that episodes will be accurate, that the service will be uninterrupted, or that it will meet your needs.

Nothing in these terms limits rights you have as a consumer that cannot be limited by law, and in some countries that includes statutory guarantees that override this section.

9. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data.

Our total liability to you for any claim arising out of these terms is limited to the amount you paid us in the 12 months before the claim.

Again, this does not limit liability that cannot be limited by law — including for death or personal injury caused by negligence, or for fraud.

10. Changes to these terms

We may update these terms. If a change materially affects you we will tell you in the app before it takes effect and update the date at the top. If you do not accept a change, stop using bre and cancel your subscription; your existing paid period is unaffected.

11. Governing law

These terms are governed by the laws of the State of Missouri, and the courts of the State of Missouri have exclusive jurisdiction — except that if you are a consumer, you may also bring proceedings in the country where you live, and you keep the protection of that country's mandatory consumer law.
